Permit guide
The Winter Springs AC permit guide
An air conditioning changeout inside the Winter Springs city limits is permitted by the City of Winter Springs Building Division at 1126 East State Road 434, 407-327-5963, through the City’s Tyler EnerGov Civic Access portal — not by Seminole County. The residential mechanical permit fee is $40 for contract value up to $1,000.00, then $60 plus $15 per $1,000.00 or portion thereof, so an $8,000 changeout is $180.
The number most local pages get wrong
$12 per $1,000 is the building permit fee. It is not your mechanical fee.
The City’s Community Development Fee Schedule, effective 18 November 2024, carries a residential mechanical permit as its own line item, separate from the building permit. The $12.00 per $1,000 of valuation figure that circulates locally is the building permit fee, with valuation set from the ICC Building Valuation Data table. It does not apply to a changeout, and quoting it will understate what you owe.
The mechanical line reads: $40.00 for contract value up to $1,000.00; $60.00 plus $15.00 per $1,000.00 of valuation or portion thereof for contract value of $1,000.01 or greater. “Or portion thereof” is why the table rounds up: a $8,500 job is charged as nine thousands, not eight and a half.
| Contract value | Mechanical permit fee | How it computes |
|---|---|---|
| $1,000 | $40 | flat, up to $1,000.00 |
| $4,000 | $120 | $60 + 4 × $15 |
| $6,000 | $150 | $60 + 6 × $15 |
| $8,000 | $180 | $60 + 8 × $15 |
| $10,000 | $210 | $60 + 10 × $15 |
| $12,000 | $240 | $60 + 12 × $15 |
| $15,000 | $285 | $60 + 15 × $15 |
How that compares with the other six Seminole County desks is on the costs page.

Your ZIP code does not settle this and neither does your mailing address. Winter Springs has had an annexation agreement with Seminole County since 1987 covering unincorporated enclaves, and the boundary has moved. The reliable check is the Property Appraiser’s parcel record for your address, which names the taxing district — the city parcels sit in districts W1 and W2 — or a call to the City Building Division at 407-327-5963 with your address in hand.
Step two
What the City actually asks for
The City of Winter Springs building permit application has a dedicated mechanical section, and it wants specifics: tons, SEER, and the system configuration — split, package, roof top, curb-stand or attic — plus the contractor licence number and the qualifier’s name. That form is itself the clearest evidence that a changeout here is a permitted, inspected, licensed-contractor job with the equipment specification on the public record.
The effective codes named on the application are the Florida Building Codes, 8th Edition 2024 — Building, Residential, Existing Building, Mechanical, Plumbing, Fuel Gas, Energy Conservation and Accessibility — with the 2023 National Electrical Code and the 8th Edition 2023 Fire Prevention Code.
The City also publishes a Pressure Test Certification Affidavit and Private Provider forms among its paper permit forms, so a private provider may be used for plan review and inspection. Contractors file a City Contractor Registration Form before they can pull permits here.

Fire review
Fire goes to the County, not to the City
The City’s fee schedule carries a footnote stating that fire permit and inspection fees are separate from the City schedule and directing applicants to the Seminole County Fire Department. Winter Springs does not run its own fire plan review for permit purposes.
For a straight residential changeout this normally does not come up. It does for anything beyond it — duct penetrating a rated assembly, commercial work, or multifamily — where you are dealing with two agencies rather than one.
Who is allowed to pull it
Licence classes, as the statute actually defines them
Florida Statutes §489.105(3) defines the air conditioning classes by scope, not by the digits in a licence number. A Class A air-conditioning contractor is unlimited. A Class B contractor is limited to 25 tons of cooling and 500,000 Btu of heating in any one system. Class C is limited to servicing existing systems and has been closed since 1 October 1988 — only people registered or certified before that date hold it.
A residential changeout sits far below the Class B cap, so either class legally covers ordinary Winter Springs residential work. Separately, DBPR distinguishes certified licences, which come from a state exam and are valid statewide, from registered licences, which come through a local jurisdiction and are valid only there.
You can verify any Florida contractor’s licence yourself at the DBPR licensee search on myfloridalicense.com. Florida Statutes §489.119(5)(b) requires a contractor’s registration or certification number to appear in every offer of services and every advertisement, whatever the medium — so if a company is advertising to you without one, that is the thing to ask about first.
Questions people actually type
Wording is left exactly as searchers type it, capitalisation included.
do i need a permit to replace my ac in florida
Yes — always, and in Winter Springs the City issues it. A mechanical permit is required for a changeout: replacing a condenser, an air handler, or both. There is no dollar-amount exemption. Florida’s new $7,500 permit exemption under HB 803 (2026), effective 1 July 2026, expressly does not apply to “any electrical, plumbing, structural, mechanical, or gas work” — s. 553.79(1)(g)2.b., Fla. Stat. — and an AC replacement is both mechanical and electrical work. What HB 803 did add is a five-business-day decision clock on the permit, but only for an existing single-family home, only where the work is valued under $15,000, and only with the City’s own plans reviewer. The statute, read correctly.
do you need a permit to replace air conditioner in florida
Same answer — yes, always — and here is the local detail that matters more than the general one: which authority. Inside the Winter Springs city limits it is the City of Winter Springs Building Division, 1126 East State Road 434, 407-327-5963, through the City’s Tyler EnerGov Civic Access portal. If your 32708 address is actually in unincorporated Seminole County it is the County Building Division, 1101 East First Street, Sanford, 407-665-7050. Filing with the wrong one is the most common local mistake we see. The “single-trade inspection” you may have read about is s. 553.791, the private-provider statute — an inspection category, not a permit exemption, and it predates HB 803.
